The Flame Club Loyalty Program for mothdrinks.com - Terms and Conditions

 

MEMBERSHIP

Flame Club, MOTH’s loyalty program is offered by MOTH Drinks Limited (registered in England and Wales, with company number 11525411 and registered office at Wisteria Grange Barn, Pikes End, Pinner, London HA5 2EX, referred to as MOTH Drinks or we/us) to customers making purchases and to potential customers on mothdrinks.com in the UK. Flame Club will extend certain perks and privileges as described on our website from time to time, and additional offers may be extended from time to time. These terms and conditions (hereinafter "Terms and Conditions") form the agreement (the "Agreement") between you ("Member") and MOTH Drinks with respect to Flame Club.

The term “Member” is used in these terms to describe any Flame Club account holder on mothdrinks.com regardless of which tier they are in.

 

MEMBERS' ACCEPTANCE OF TERMS

By participating in Flame Club, Members agree to the terms and conditions, rules, regulations, policies and procedures of the Program from time to time, including, without limitation, these Terms and Conditions. Each Member is responsible for remaining knowledgeable about the Flame Club Terms and Conditions. MOTH Drinks reserves the right to disqualify Members who have violated any of the Program rules including these Terms and Conditions.

 

MOTH DRINKS' RIGHT TO CHANGE/CANCEL PROGRAM

MOTH Drinks may alter, limit, modify or terminate Flame Club, the rewards structure, any other feature of the Flame Club, or these Terms and Conditions in its sole and absolute discretion at any time and in any manner without notice. Your continued participation in Flame Club will confirm your acceptance of such changes.

 

MEMBERSHIP ELIGIBILITY

The Program is open to UK residents (excluding Northern Ireland) over age 18. Proof or age and/or residency may be required. Membership is limited to individuals only and is limited to one account per individual. Membership is not available to corporations, businesses, charities, partnerships, clubs, associations, enterprises or anyone other than an individual, unless written approval is received in advance from MOTH Drinks, in its sole and absolute discretion.

 

MEMBERSHIP ENROLLMENT

Individuals must create an account to become a member. This can be done here: mothdrinks.com/pages/account. Members must provide information accurately and completely when creating an account. Members will be eligible for benefits once they have verified their email address. MOTH Drinks reserves the right to refuse membership to any customer who does not follow the enrollment procedures. The customer is responsible for updating any contact information by visiting www.mothdrinks.com and updating their account. Any individual with an existing account will automatically be enrolled in Flame Club.

 

PROGRAM COMMUNICATIONS

A current, valid email address is required for a Member to be eligible for and receive select benefits, offers and updates. Member must notify MOTH Drinks of change of email address by updating Member account information online.

MOTH Drinks will communicate with Members about marketing via mail, email, SMS and other channels, including about special promotions, offers and more. MOTH Drinks will also use these channels to communicate the Member’s tier status, notify members of eligibility for a benefit, communicate Flame Club changes and more. By signing up to the Flame Club rewards program, members consent to receive communications regarding their rewards and account. Please note that even if you opt out of receiving marketing or promotional communications, MOTH Drinks may continue to send you non-marketing or non-promotional emails, such as those about your account, rewards or our ongoing relationship.

 

DATA PROTECTION AND PRIVACY

 As a Member, you have various rights in relation to personal information that we hold about you.

PURCHASES AND RETURNS

Product purchases and returns must be made in accordance with MOTH Drinks' terms and conditions and return policy in force from time to time. Once Moth Drinks has received the return, the value applied to Program Tier status for the original purchase will be deducted from the Member's account.

 

ELIGIBLE PURCHASES

Purchases of products after promotional offers have been applied, before taxes and shipping charges have been applied, made at mothdrinks.com, count toward your Program tier status. The amount of a purchase made with a MOTH gift card as method of payment will not be applied to Tier Level earnings. The purchase of a MOTH gift card will be applied to Tier Level earnings. Additional items may be included or excluded from Tier Level accumulation at the sole discretion of MOTH Drinks.

 

TIER STATUS

Flame Club tier status is based solely on a customer’s total spend on mothdrinks.com in a 12 month rolling period. Eligible purchases that were completed longer than the 12 month rolling period will no longer contribute to your tier level status and you may move down a tier.

 The criteria for each Tier are as follows:

  • Member: A customer receives Member status upon creating an account at mothdrinks.com. That account will retain Member status until they have spent £100 at which point they will be eligible to move into Mate tier.
  • Mate: If a customer’s account accumulates £100 of total spend on mothdrinks.com, they will move into Mate tier.
  • Devotee: If a customer’s account accumulates £400 of total spend on mothdrinks.com, the customer will move into Devotee tier.
  • If there is any dispute as to a Member’s Tier level status, the decision of MOTH Drinks will be final.

Purchases made prior to either 25th September 2024 or creating a Flame Club account will not be eligible towards your tier level spend.

RIGHT TO REVOKE

MOTH Drinks reserves the right to revoke the membership for any reason and at any time.

If a Member abuses any of the Program privileges, fraudulently uses the Program, fails to comply with these Terms and Conditions or otherwise earns benefits through deception, forgery and/or fraud they will be removed from the program.

 

NO TRANSFER OR CASH EQUIVALENT

Program benefits may not be transferred, purchased, sold, assigned, auctioned or traded. Doing so will void the Member account. Benefits have no cash value and are not exchangeable for cash.

 

NO LIABILITY

The Flame Club program is a discretionary program operated by MOTH Drinks. MOTH Drinks will not be liable for any loss or damage that Members or any other person may suffer as a result of their membership, failure to obtain benefits therefrom, withdrawal of membership or the program generally, or anything else connected with the Flame Club. Nothing affects a consumer’s statutory rights. Nor does anything limit MOTH Drinks’ liability for death or personal injury caused by its negligence, for fraud, or for anything else liability for which cannot, as a matter of applicable law, be limited.
