The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

 If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part there of).

Which payment methods do we accept? 

Visa, MasterCard, American Express, Maestro, Apple Pay, Shop Pay & Paypal.

When will I be charged? 

If your card is authorised, payment will provisionally be taken from your account immediately by your card issuer. 

All of our products are priced in GBP and then translated using up-to-date exchange rates.

Why has my payment method been declined? 

Please check the card details you have entered including expiry date, billing address and security code. 

If all of these are correct your card issuer may have declined your payment. 

As card issuer’s do not share this information with us it is advisable that you contact your card issuer directly. 

You may be prompted by your bank to add a 3D secure verification password at the end of your payment. 

3D secure is an additional security measure for online credit and debit card transactions (Visa and Mastercard). It is controlled by Visa and Mastercard. 

If you are having problems remembering your password, please contact your credit card company in order to reset your password or simply request a password reset at the point of verification. 

All refunds will be processed via the original payment method. 

VAT & CUSTOMS/IMPORT CHARGES FOR ONLINE ORDERS 

VAT is payable on all online shop orders shipped to a UK address regardless of the country where the order is placed. 

We do not accept orders from outside the UK.

Paying by Paypal

Go through the secure checkout as normal and select ‘PayPal'. You will be taken to the PayPal site to log into your account and set up the payment. You will be automatically returned to the MOTH Drinks site to confirm the payment total and place the order. Your PayPal account will show a charge to MOTH Drinks. It is not possible for us to change this name on the PayPal system.

Delivery: 

Before you place your order, you are given various delivery options to choose from with estimated delivery times. Once the order has been placed, these are then unable to change.  

We work hard to make sure that our orders arrive on time. Unfortunately, on occasion there may be delays. If delays do occur, we would do our best to contact you and inform you of these delays along with giving you (the customer) tracking details so that you are able to track your delivery.  

PROMOTIONS

From time to time, we may offer our customers a discount code to reduce the price of an order from our website.  Remember, it is up to the you (the customer) to enter this code at the checkout! 

Each discount code may have a specific set of terms to meet the discount code requirement.  

Each discount code cannot be referred to another customer and must only be used when meeting the terms of the discount code.

MOTH Drinks reserves the right, in its sole discretion, to determine that a person is not eligible for offer redemption for any reason, including, but not limited to, order contents not eligible for promotion, suspected fraud, or breach of these Terms and Conditions.

From time to time we run prize giveaways. The below terms and conditions apply.

Giveaway details form part of these terms and conditions- Entry is open to residents of the UK except for employees (and their families) of MOTH, the suppliers of the prizes and any other companies associated with the competitions.

The entrant(s) must be aged 18 or over and proof of identity and age may be required.

Use of a false name or address will result in disqualification.

All entries must be made directly by the person entering the prize giveaway.

Entries made online using methods generated by a script, macro or the use of automated devices will be void.

No responsibility can be accepted for entries lost, delayed or corrupted, or due to computer error in transit.

The prizes/tickets are as stated, are not transferable to another individual and no cash or other alternatives will be offered.

Prizes are subject to availability and the prize suppliers’ terms and conditions.

Owned Social Media channels refers to accounts held by MOTH Drinks and using for both unpaid and paid posts including advertising.

No purchase necessary to enter relevant giveaways.

Giveaway are open to UK mainland residents aged 18 years or over only.

Entries must be received by the closing date stated in the original post or before suspension of publishing in the case of an advertisement. The Promoter’s accept no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the host by the relevant closing date for any reason. Proof of posting or sending is not proof of receipt. Automatically generated entries and entries via agents or third parties are invalid and will not be counted. Entries become the property of the Promoter and host and are not returned.

The prize for the winner is as described in the original post. If the prize is described as "a year's supply of MOTH" this is defined as x12 Pack of 12 MOTH Taster Pack, totalling 144 cocktails. Number of winners, where more than 1 will be stated here.

This competition is in no way affiliated with  any other third parties, including supermarket suppliers, TikTok or Instagram.

Entrants will be required to provide their full name, postal address, email address, telephone number and date of birth to be shared with MOTH Drinks and competition partner ,where relevant, for delivery purposes only. The prize can only be delivered to addresses within the UK mainland.

Prizes are subject to availability. In the event of unforeseen circumstances, the Promoter reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into.

MOTH COCKTAIL ADVENT CALENDAR | ADDITIONAL TERMS

To win, the purchaser of the Advent Calendar must find a 1 of 10 specially labelled cans of MOTH, which have the copy "You've won" on the front.

Other terms and conditions stated above will also apply.

Redemption must be requested prior to the 31st January 2025. Remdemptions following this will not be valid.

The winner will be required to submit a small video clip with the can and other supporting details present on the can itself for redemption.

The Moth Drinks Gift Card (“Gift Card”) is provided as a unique code redeemable at Moth Drinks’s UK website only for online purchases in the UK. 

Gift Cards have an expiration date one year after purchase. They cannot be redeemed for cash or cash equivalent, except as required by law.

Unredeemed value on lost or stolen Gift Cards will only be replaced if purchaser's confirmation email is presented as proof of purchase and we confirm the Gift Card has not already been redeemed in full. 

If purchased on Moth Drinks’s website, Gift Card can be cancelled prior to the delivery date selected during the order process or up to 14 days after you receive it, and in either case, refunds for cancelled Gift Cards are subject to deductions in for any value which has been redeemed) by contacting the MOTH at support@mothdrinks.com 

Gift Cards are void if copied (other than for the purpose of making a back-up of your own Gift Card details), resold or otherwise obtained or used in violation of these terms. We may, where we have reason to suspect fraud or breach of these terms (for example where we’ve been notified a Gift Card has been lost, or where it otherwise seems likely to have been misappropriated, from the appearance of the Gift Card or other circumstances) request evidence, where appropriate, to confirm you are the purchaser or intended recipient of the Gift Card before we accept it. 

Further, use of Gift Cards for unauthorized advertising, marketing or other promotional purposes associated with the Moth Drinks brand is strictly prohibited.

TERMS AND CONDITIONS

MEMBERSHIP

Flame Club, MOTH’s loyalty program is offered by MOTH Drinks Limited (registered in England and Wales, with company number 11525411 and registered office at Wisteria Grange Barn, Pikes End, Pinner, London HA5 2EX, referred to as MOTH Drinks or we/us) to customers making purchases and to potential customers on mothdrinks.com in the UK. Flame Club will extend certain perks and privileges as described on our website from time to time, and additional offers may be extended from time to time. These terms and conditions (hereinafter "Terms and Conditions") form the agreement (the "Agreement") between you ("Member") and MOTH Drinks with respect to Flame Club.

The term “Member” is used in these terms to describe any Flame Club account holder on mothdrinks.com regardless of which tier they are in.

MEMBERS' ACCEPTANCE OF TERMS

By participating in Flame Club, Members agree to the terms and conditions, rules, regulations, policies and procedures of the Program from time to time, including, without limitation, these Terms and Conditions. Each Member is responsible for remaining knowledgeable about the Flame Club Terms and Conditions. MOTH Drinks reserves the right to disqualify Members who have violated any of the Program rules including these Terms and Conditions.

MOTH DRINKS' RIGHT TO CHANGE/CANCEL PROGRAM

MOTH Drinks may alter, limit, modify or terminate Flame Club, the rewards structure, any other feature of the Flame Club, or these Terms and Conditions in its sole and absolute discretion at any time and in any manner without notice. Your continued participation in Flame Club will confirm your acceptance of such changes.

MEMBERSHIP ELIGIBILITY

The Program is open to UK residents (excluding Northern Ireland) over age 18. Proof or age and/or residency may be required. Membership is limited to individuals only and is limited to one account per individual. Membership is not available to corporations, businesses, charities, partnerships, clubs, associations, enterprises or anyone other than an individual, unless written approval is received in advance from MOTH Drinks, in its sole and absolute discretion.

MEMBERSHIP ENROLLMENT

Individuals must create an account to become a member. This can be done here: mothdrinks.com/pages/account. Members must provide information accurately and completely when creating an account. Members will be eligible for benefits once they have verified their email address. MOTH Drinks reserves the right to refuse membership to any customer who does not follow the enrollment procedures. The customer is responsible for updating any contact information by visiting www.mothdrinks.com and updating their account. Any individual with an existing account will automatically be enrolled in Flame Club.

PROGRAM COMMUNICATIONS

A current, valid email address is required for a Member to be eligible for and receive select benefits, offers and updates. Member must notify MOTH Drinks of change of email address by updating Member account information online.

MOTH Drinks will communicate with Members about marketing via mail, email, SMS and other channels, including about special promotions, offers and more. MOTH Drinks will also use these channels to communicate the Member’s tier status, notify members of eligibility for a benefit, communicate Flame Club changes and more. By signing up to the Flame Club rewards program, members consent to receive communications regarding their rewards and account. Please note that even if you opt out of receiving marketing or promotional communications, MOTH Drinks may continue to send you non-marketing or non-promotional emails, such as those about your account, rewards or our ongoing relationship.

 As a Member, you have various rights in relation to personal information that we hold about you.

PURCHASES AND RETURNS

Product purchases and returns must be made in accordance with MOTH Drinks' terms and conditions and return policy in force from time to time. Once Moth Drinks has received the return, the value applied to Program Tier status for the original purchase will be deducted from the Member's account.

ELIGIBLE PURCHASES

Purchases of products after promotional offers have been applied, before taxes and shipping charges have been applied, made at mothdrinks.com, count toward your Program tier status. The amount of a purchase made with a MOTH gift card as method of payment will not be applied to Tier Level earnings. The purchase of a MOTH gift card will be applied to Tier Level earnings. Additional items may be included or excluded from Tier Level accumulation at the sole discretion of MOTH Drinks.

TIER STATUS

Flame Club tier status is based solely on a customer’s total spend on mothdrinks.com in a 12 month rolling period. Eligible purchases that were completed longer than the 12 month rolling period will no longer contribute to your tier level status and you may move down a tier.

 The criteria for each Tier are as follows:

• Member: A customer receives Member status upon creating an account at mothdrinks.com. That account will retain Member status until they have spent £100 at which point they will be eligible to move into Mate tier.
• Mate: If a customer’s account accumulates £100 of total spend on mothdrinks.com, they will move into Mate tier.
• Devotee: If a customer’s account accumulates £400 of total spend on mothdrinks.com, the customer will move into Devotee tier.
• If there is any dispute as to a Member’s Tier level status, the decision of MOTH Drinks will be final.

Purchases made prior to either 25th September 2024 or creating a Flame Club account will not be eligible towards your tier level spend.

RIGHT TO REVOKE

MOTH Drinks reserves the right to revoke the membership for any reason and at any time.

If a Member abuses any of the Program privileges, fraudulently uses the Program, fails to comply with these Terms and Conditions or otherwise earns benefits through deception, forgery and/or fraud they will be removed from the program.

NO TRANSFER OR CASH EQUIVALENT

Program benefits may not be transferred, purchased, sold, assigned, auctioned or traded. Doing so will void the Member account. Benefits have no cash value and are not exchangeable for cash.

NO LIABILITY

The Flame Club program is a discretionary program operated by MOTH Drinks. MOTH Drinks will not be liable for any loss or damage that Members or any other person may suffer as a result of their membership, failure to obtain benefits therefrom, withdrawal of membership or the program generally, or anything else connected with the Flame Club. Nothing affects a consumer’s statutory rights. Nor does anything limit MOTH Drinks’ liability for death or personal injury caused by its negligence, for fraud, or for anything else liability for which cannot, as a matter of applicable law, be limited.
